Terms of Service

These Terms govern your use of DukanIQ: the mobile app, the website at dukaniq.app and the merchant dashboard. By creating an account or using the service you agree to them. If you do not agree, please do not use DukanIQ.

1. 1. The service

   DukanIQ is a marketplace. Products are listed and sold by independent stores, not by DukanIQ. Each store is responsible for its products, descriptions, prices, stock and delivery.

   DukanIQ provides the platform, passes orders between you and the store, and helps resolve problems.

2. 2. Your account

   You must give accurate information, verify a phone number you own and keep your password secret. You are responsible for what happens on your account.

   The account type you choose when signing up, customer or store owner, cannot be changed later. Store staff act on behalf of the store that invited them.

3. 3. Orders and payment

   Each order is placed with one store, from that store's basket. Prices are in Iraqi dinars and set by the store. The delivery fee and estimated time are set by the store for your area and shown before you confirm.

   Payment is cash on delivery unless another method is offered at checkout.

   A store may reject an order or remove an item it cannot supply; you are told and the total is recalculated. You can cancel an order until it is out for delivery.

4. 4. Returns

   Where an order is eligible, you can request a return in the app within the period shown on the order. The store inspects what comes back and records the return.

   The refund is the amount the store records, which may be less than the estimate shown in your request if items are missing or damaged. Delivery fees are not refunded.

5. 5. Promo codes and referrals

   Codes are issued by stores or by DukanIQ and carry the conditions shown with them. One code applies per basket. Codes have no cash value and may be withdrawn at any time; orders already placed keep their discount.

   Referral and welcome rewards are honoured only at stores that take part. We may cancel codes or rewards obtained by abuse.

6. 6. Stores and merchants

   Merchants must list only lawful goods they are able to sell, describe and price them accurately, honour orders they accept, keep their delivery areas up to date and treat customers fairly.

   Paid plans are charged per period at the prices shown on the plan. A move to a smaller plan takes effect when the current period ends, and a store must fit the limits of the plan it moves to.

   Merchants are responsible for the discounts they fund and for following the laws that apply to their business, including tax.

   We may suspend a store that is inactive, unpaid or in breach of these Terms.

7. 7. Your content

   Reviews, photos, store listings and other content you submit remain yours. You give DukanIQ a non-exclusive, royalty-free licence to host, display and adapt it, for example resizing images, to run and promote the service.

   Content must be honest and lawful, and a review must describe a real purchase.

8. 8. What is not allowed

   Selling or listing prohibited, counterfeit or stolen goods; posting false, abusive, hateful or sexual content; impersonating anyone; manipulating reviews, ratings or promotions; scraping the service, interfering with it or bypassing its security; or using it for anything unlawful.

   Anyone can report a product. We review reports and may remove content or restrict accounts.

9. 9. Suspension and closing

   You may stop using DukanIQ and delete your account at any time, as described in the Privacy Policy.

   We may suspend or close accounts and stores that breach these Terms or put others at risk, and remove content that does.

10. 10. Liability

    The service is provided as it is. Stores, not DukanIQ, are responsible for the goods they sell and for delivering them.

    To the extent the law allows, DukanIQ is not liable for indirect losses, and our total liability for any claim is limited to the fees you paid us in the twelve months before it. Nothing in these Terms limits liability that the law does not allow to be limited.

11. 11. Changes

    We may change the service and these Terms. We will update the date above and give notice in the app of significant changes; using DukanIQ after they take effect means you accept them.

12. 12. Law and disputes

    These Terms are governed by the laws of the Republic of Iraq. We will first try to resolve any dispute with you directly; failing that, the competent courts in Baghdad have jurisdiction.
